Terms and Conditions for use of the websites https://www.gingercity.com and https://www.ranya.net and other related sites owned by Ginger City LLC (including but not limited to https://members.gingercity.com).

FOR PURPOSES OF THESE TERMS AND CONDITIONS:
“You” means the person who completes the transaction and makes a purchase in our shopping cart system and who otherwise visits the websites https://www.gingercity.com or https://www.ranya.net or other related sites owned by Ginger City LLC (including but not limited to https://members.gingercity.com).
“We” or “us” means Ginger City LLC.
“Our sites” refers to the websites https://www.gingercity.com and https://www.ranya.net and other sites owned by Ginger City LLC (including but not limited to https://members.gingercity.com).
“End User” means any user of the websites https://www.gingercity.com or https://www.ranya.net or other sites owned by Ginger City LLC (including but not limited to https://members.gingercity.com).

ONLINE STOREFRONT OR SHOPPING CART PAYMENT PROCEDURES
Payments are processed securely via PayPal or via Stripe (for credit or debit card) SSL encryption through our shopping cart service, Thrivecart. You do not need a PayPal or Stripe account to make purchases: You may pay with a major credit or debit card. If you have a PayPal account, you can also log onto http://paypal.com to confirm details of your transaction. You will receive a payment confirmation email. Please save a copy of your payment confirmations for your records; you may also look up your payments and other transactions with us via the link in your invoice.
REFUND POLICY
Payments for memberships, private lessons, workshops and classes are non-refundable and non-transferable, unless there is a specific exception explicitly offered in writing by us at the time of registration, such as a time-limited guarantee offered at time of purchase for a particular course, or the option to transfer your registration to another person, specifically stated in the advertising. If it is not specifically stated at the time of payment, then it is non-refundable and non-transferable. We reserve the right to charge an administrative fee for transactions that require changes to registrations or for other special registration situations.
We do not generally provide refunds or exchanges on opened DVDs or CDs ordered on Our sites, unless an item is determined to be defective in which case, following your return of defective merchandise to our office, we will send you a replacement or a refund at our discretion. If you have any questions about your order you may contact us at support@gingercity.com.
While it is extremely rare, if you have purchased a copy of one of our DVDs that is determined after testing on more than one device to be defective, we will help you to get a replacement. Replacements for defective copies of the Bellydance Egyptian Style: The Baladi and Bellydance Egyptian Style: Modern Oriental DVDs are handled through World Dance New York, a company not related to us. You may contact them directly to make arrangements or contact our office at support@gingercity.com, and we will undertake best efforts to help facilitate contact with them.
Once you have ordered an item to be shipped to you, if you decide to change your order before it has shipped, we will transfer your payment to an item of equal or lesser value and send you a refund for any difference. You must contact us immediately to make any changes to your order. If you order a CD or DVD, we will issue a refund or credit (your choice) if the item is not available to be shipped to you. All refunds are issued through PayPal. As with purchases from the shop, you do not need a PayPal account in order to receive a refund. Orders are shipped once per week, usually on a Wednesday or Saturday. You may contact our office to check when your order will be shipping, at support@gingercity.com. Please look for emails from us at support@gingercity.com in case we have any questions for you about your order.
CANCELLATION POLICY
We are not able to offer refunds for any purchases, paid programs on our sites, or programs such as in-person workshops paid for via our sites, unless explicit language exists for that program that there is a money-back guarantee trial period within which to request a refund. No refunds or transfers will be issued for the Ginger City membership or any other online courses or in-person courses that do not contain the “money-back guarantee” language at the time of purchase. If you sign up for a membership trial offer and decide to cancel, you must do so before the end of your trial period via the Customer Hub, accessible from the MY ACCOUNT tab in the upper right corner of our site or from one of your invoices, to avoid being billed. Under no circumstances can we refund payment for a membership or other product payment after the trial period has ended, or after payment has been made without timely cancellation. Please read below for the distinction between membership recurring payments (not active at the time of this updated Terms & Conditions, but which may be offered in the future) and payment plan/installment plan payments for a program, which represent an ongoing commitment until the total has been paid.
For membership recurring payments: If you are part of a recurring membership program on the Our website, you may cancel your membership on your own at any time prior to the end of your billing cycle, via the Customer Hub, accessible from the MY ACCOUNT tab in the upper right corner of our site or from one of your invoices. If there is any failure in your attempt to cancel your membership via the Customer Hub, you must send us an email to alert us, which will be time-date stamped so we will have a record of your timely request. If you intend to cancel an existing term membership (monthly up to annual) before your next billing date, you must do it at least 72 hours before the rebill date to be sure it processes correctly. Even if you cancel well in advance of your next billing date, you will still maintain your access to the website through the end of your paid membership cycle. For installment plan payments for a coaching series or other program: Installment plans represent your commitment to complete payment for a program for which you have initiated payment and may not be cancelled. Under certain rare circumstances, such as an otherwise sold-out coaching series or workshop, you may transfer your registration to another person in your place in which case that person will be deemed to agree to these Terms and Conditions and to our Privacy Policy. You will be responsible for the ongoing installment payments unless and until the other person is able to assume responsibility for the payments. Any such arrangements must be approved by us in writing. We reserve the right to charge an administrative fee for transactions that require changes to registration. Memberships or non-limited-enrollment course purchases are not transferable under any circumstances. Depending on your payment method, a membership may be able to be paused, for a limited time, in the case of a documented medical emergency, illness or death in the family, from 72 hours after you notify us. Please note that we are not be able to pause subscriptions, due to restrictions of the payment processor used in transactions. Contact us at support@gingercity.com if you have questions about this.

PARTICIPATION AND ACCESS
Our websites are only intended to be used by people 18 years of age or older. Some material on Our sites may not be appropriate for children. In continuing to use our sites, you acknowledge that you are 18 years of age or older. Please safeguard your login and password such that it is not available to others. Your login credentials are for you alone. It is a violation of our policy to share your login credentials with anyone else, and your access to the membership website will be terminated immediately if we detect suspicious activity on your account.
Our membership site is not intended to be an “anonymous” membership. Because some of the material discussed on the membership site may be sensitive, we strive to create a safe space to the extent we are able to. Therefore, we may ask you to provide information to verify to us that you are a real person, and that you are not spoofing or otherwise hiding your identity from us. Using a pseudonym or stage name on our site in the site forum and in meetings is permitted, as long as you do not hide your legal identity from us. We reserve the right to screen members, and to restrict or remove your access to our website or our membership site forum for any reason, including on the suspicion that you may be gaining fraudulent access to our membership site, borrowing another person’s credentials to log in, hiding your identity, spoofing, fraud, belligerent or threatening behavior, or stalking or harassing any of our site’s members or our staff or volunteers, either in person or by any media, including but not limited to telephone, message apps, and social media platforms. You may be asked to provide us with additional information to aid us in determining if you are a good fit for our site community. If your membership is rejected and access removed based on our determination, you may not be eligible for any refunds. We hold the exclusive right to remove your access to programming on Our sites, including for courses designated as "lifetime access."
RELEASE FROM LIABILITY
Dance and other movement exercises may be physically demanding and strenuous, and may carry the risk of injury. Movements we teach or recommend may not be appropriate for all people. In participating in our online live or recorded programs, you agree to do your own due diligence, including consulting with your own medical providers, to determine whether any particular exercise or exercise program is appropriate and safe for your body. Please contact your physician before beginning any program contained on our DVD video programs and/or on Our sites. Our content is not intended in any way to be medical advice and should not be taken as such. Technique instructions or recommendations of exercises, postures, movements, or other actions that may appear in our website content may not be safe or appropriate for all users of our sites, and we do not warrant them to be safe or appropriate for everyone. Neither Ginger City LLC nor its owners nor any of its staff members, volunteers, presenters, instructors or representatives will be responsible for any liability or any risk of bodily injury, physical damage or other disability, or property damage which results or may result from the use of any DVD or website video program, whether caused by negligence or otherwise. You should always use best efforts to help protect against the risk of any such damages.
We undertake best efforts to keep our website platforms free of errors, viruses, and other malevolent actions on our sites, such as hacking, and we employ SSL (secure sockets layer) security to help prevent such damage to our sites. However, as with any web-based platform, there is a risk that websites may become corrupted or damaged, and this risk is shared by you as the End User of our sites. In using our sites, you acknowledge that you assume all potential risks associated with such damage that may occur during or as a result of your use of our sites. We will not be held responsible for any damage to your computer, phone, tablet or other devices as a result of your use of our site, nor any temporary denial of service caused by damage to or failures on our sites. We will undertake best efforts to quickly fix any problems that arise on our sites from such causes.

USAGE OF PROGRAMS ON OUR SITES
Instructional content in any form: Ginger City LLC maintains the rights to any instructional content posted on Our sites that has been created by us, and we make available third-party content on a quitclaim basis, meaning that you as an End User of our Sites do not have the right to replicate, reproduce, claim as your own, or distribute the instructional content provided by us, without our express written consent to do so. If you do replicate, distribute, claim as your own, or reproduce our content, then you are stealing our work, and subject yourself to legal action by us and possibly by third parties.
Video programs: You as the End User are entitled to view, via streaming access only, any video programs you have legitimate paid access to via your membership or as granted by us. You do not have the right to download, make a copy, or film for non-streamed usage any of our video programs, either for your own personal usage or for distribution to others.
Audio programs: In some cases you will be permitted to download audio files for your own personal use only, not for distribution to others in full or in part, unless our explicit written permission is obtained by you for the sharing of any of this content. In cases where you are permitted to download the audio file, we will provide that file to you. You are not permitted to copy or "rip" any audio in cases where we do not make the file available to you.
PDFs and other written or printed materials (including but not limited to blog posts, class descriptions and instructions, checklists, music maps, and other printed resources): You are permitted to download posted downloadable PDFs of certain resources for your own personal use, not for distribution to others in full or in part, unless our explicit written permission is obtained by you for the sharing of any of this content, including which specific content you are seeking permission for. If permission is granted, you must adhere to guidelines we give you for how the material is to be credited, or it will be considered a violation of our Terms and Conditions.
Violations of our usage policy will result in immediate lifetime banning from our websites, with no refunds given, and violators will be subject to further legal action by us. Any legal actions we take will be filed according to and governed by the laws of the state of New York, United States of America.

Our sites may contain links to third-party websites or applications, or recommendations for third-party websites, applications, or products. We are in no way responsible for the content of third-party websites, applications, or products, the continued availability of such content, or the proper functioning of third-party websites. AVAILABILITY OF THIRD-PARTY VIDEO FOOTAGE MUSIC RIGHTS AND VIDEO FOOTAGE
We hold no responsibility to deliver content from videos posted on third-party websites and linked to on Our sites if the original links or their content are disabled or changed. We ask you to bring this to our attention if you notice it, but we will not have responsibility for replacing that lost or disabled content provided via such links. Depending on the music rights and policies of third-party websites hosting your posted videos or any other videos linked to on our websites, you may find that the sound has been removed from videos you or we have posted. Ginger City LLC will hold no responsibility for such policies of third-party websites and their effects on the availability of videos on Our sites.
AVAILABILITY OF LIVE CLASSES AND RECORDINGS OF LIVE CLASSES
We will undertake our best efforts to film live meetings or classes at the scheduled time, but there may be circumstances where we are unable to do this. Such circumstances may include but are not limited to: technical problems with filming or recording equipment or with the conferencing or streaming service; interference or interruptions in the Ginger City studio; schedule changes of presenters or staff; illness, injury, or other significant personal life events of our presenters or staff; travel or transit delays; electricity or internet outages or slowdowns, weather-related issues or “Acts of God”; or other circumstances that may affect the start or end time of a scheduled live meeting or our ability to deliver the meeting in a live format. If such cases so arise, we will undertake our best efforts to arrange for a makeup of the scheduled content or similar content at another time, either in the form of an added live session or added recorded content to the site. We reserve the right to delay any previously announced content. We further reserve the right to replace any planned live content with prerecorded content and vice versa, and in some cases may not be able to replace the planned class or meeting.
Live classes and other live sessions (such as webinars and Q&A sessions), once filmed, will be added to the membership library of programs in a timely fashion. We will undertake best efforts to have class video recordings available for viewing no more than one (1) week after the date of the live class, earlier if at all possible. Delays may occur as with any of the aforementioned circumstances that could affect live classes, or other circumstances not listed above. In using our site, you acknowledge that there may be delays in the filming or posting of content. We will make our best efforts to stay on our planned production and posting schedule. We reserve the right to change the amount or type of content posted.
AVAILABILITY OF PROGRAMS ON OUR MEMBERSHIP SITE
Recorded video and audio classes and programs are posted in Our membership site with our intention of keeping them available for streaming for the life of your membership. However, under certain circumstances, we may need to edit or remove some of our recorded programming completely from the site. These circumstances include but are not limited to: our decision to update, replace, or retire specific content from the site, changes in music or video usage permissions, and other situations not as of yet determined. Replacing individual content that is removed, in such instances, will be solely at our discretion, and we will not be held responsible for reinstating or replacing content that has been removed by us in such circumstances. You as a member have the right to cancel your membership. We will not be held liable to provide compensation for any material that has been removed from Our sites, in the event you choose to cancel your membership, or in the event that we, at our discretion, make a decision to terminate your membership.
TERMS & CONDITIONS MODIFICATION
We reserve the right to modify these Terms and Conditions at any time without prior notice to you. It is your responsibility to periodically review the Terms and Conditions and other information contained on Our site. Your continued use of our websites is subject to the most current version of the Terms and Conditions posted on the sites at the time of your use.
